Terms of Service

These Terms of Service ("Terms") govern your use of services provided by Fantastic NZ Hosting ("we", "us", "our"), a New Zealand business. By purchasing or using our services, you agree to these Terms.
1. Services
We provide web hosting, domain registration, email hosting, and anti-spam filtering services. All services are provided on a best-effort basis with the goal of maximum uptime and reliability.
2. Account Registration
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old or have parental/guardian consent
- One person or entity per account — accounts are non-transferable
3. Payment Terms
- All prices are in New Zealand Dollars (NZD) unless stated otherwise
- Payment is due at the time of purchase and on each renewal date
- We accept PayPal and major credit/debit cards
- Invoices are issued 14 days before the due date
- Late payments may result in service suspension after 7 days overdue
- All prices are exclusive of GST (Goods and Services Tax) where applicable
4. Service Level Agreement
- Uptime target: 99.9% monthly uptime for hosting services
- Planned maintenance: Scheduled outside NZ business hours with 48 hours notice
- Support response: Critical issues within 1 hour, standard within 24 hours
- Backups: Daily automated backups retained for 30 days (not a substitute for your own backups)
5. Acceptable Use Policy
You must not use our services to:
- Send unsolicited bulk email (spam)
- Host or distribute malware, viruses, or malicious code
- Infringe intellectual property rights or copyrights
- Store or distribute illegal content under New Zealand law
- Conduct phishing, fraud, or identity theft
- Launch denial-of-service attacks or attempt to compromise other systems
- Host content that violates the Harmful Digital Communications Act 2015
- Mine cryptocurrency without prior written approval
- Exceed allocated resource limits (CPU, RAM, bandwidth, storage)
Violation of this policy may result in immediate suspension or termination without refund.
6. Domain Registration
- Domain registrations are subject to the terms of the relevant registry (.nz, .com, etc.)
- .nz domains are governed by the InternetNZ Domain Name Commission policies
- Domain transfers and renewals are the customer's responsibility
- We are not liable for domain disputes — these are handled via UDRP or DNC processes
7. Anti-Spam Services
- Our spam filtering is provided on a best-effort basis — no filter is 100% effective
- We are not liable for emails incorrectly classified as spam (false positives) or spam that passes through (false negatives)
- Quarantined emails are retained for 30 days then permanently deleted
- You are responsible for reviewing your quarantine regularly
8. Data Protection
We handle your data in accordance with the New Zealand Privacy Act 2020. See our Privacy Policy for full details.
9. Backups and Data Loss
- We perform daily automated backups as a courtesy service
- Backups are not guaranteed and should not be relied upon as your sole backup
- You are responsible for maintaining your own independent backups
- We are not liable for data loss due to hardware failure, software bugs, human error, or force majeure
10. Limitation of Liability
- Our total liability is limited to the fees paid for the service in the 12 months preceding the claim
- We are not liable for indirect, consequential, or incidental damages
- We are not liable for loss of business, revenue, data, or profits
- These limitations apply to the fullest extent permitted by the Consumer Guarantees Act 1993 and Fair Trading Act 1986
11. Consumer Guarantees Act 1993
Where our services are acquired for personal or domestic use, the Consumer Guarantees Act 1993 applies and nothing in these Terms limits your rights under that Act. If our services fail to meet a consumer guarantee, you may be entitled to a remedy including repair, replacement, or refund.
12. Suspension and Termination
- We may suspend services for non-payment, AUP violations, or legal requirements
- You may cancel services at any time via your billing portal
- Refunds are provided on a pro-rata basis for annual plans cancelled within 30 days
- No refunds for monthly plans or services used beyond 30 days
- Upon termination, your data will be retained for 30 days then permanently deleted
13. Intellectual Property
You retain ownership of all content you upload to our servers. We retain ownership of our website, branding, software, and infrastructure. You grant us a limited licence to host and serve your content for the purpose of providing our services.
14. Dispute Resolution
- Disputes will first be addressed through our support system
- If unresolved, disputes will be referred to mediation under the Arbitration Act 1996
- These Terms are governed by the laws of New Zealand
- The courts of New Zealand have exclusive jurisdiction
15. Force Majeure
We are not liable for failures caused by events beyond our reasonable control, including natural disasters, power outages, internet disruptions, government actions, pandemics, or cyberattacks.
16. Changes to These Terms
We may update these Terms with 30 days notice via email or our website. Continued use of our services after changes take effect constitutes acceptance.
